LEGAL ISSUES, NEW RIGHTS & LAWS RELATED TO DOMESTIC WORKERS IN INDIA

»  Domestic workers come from vulnerable communities and backward areas. The majority are poor, illiterate, unskilled and do not understand the urban labour market. Their work is undervalued, underpaid and poorly regulated.

»  The rapid urbanization, combined with the rise in the disposable incomes Of a growing middle class, have made domestic help more necessary than ever, but this growing demand for domestic workers has also led to different forms of exploitation of millions of Women and children domestic workers of the both sexes.

USD Consortium organized a workshop on 12th July,2016 where in legal expert Ms. Mohna Sharma was invited
to address these exploitation issues and create a legal awareness among domestic workers on various new laws, rights & other measures adopted by our Govt. &/or other social agencies for the welfare of Domestic Workers. She also gave advise on legal solutions to various problems / exploitation issues of many Domestic Workers who attended the session.

Our legal expert told us that the Government of India in recent years has sincerely taken some steps to provide legal protection and social security to domestic workers. Like they have been included in The Unorganized Workers’ Social Security Act (2008) and the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act (2013). There have been other measures as well, like extension of the Rashtriya Swasthya Bima Yojana (RSBY) to cover domestic workers and the notification of Minimum Wages by a few State governments etc.

After various enthusiastic interactive sessions with Domestic Workers

  • USD Consortium found that ----

Depriving domestic workers from their entire salary, average working hours- more then 16-18 hours of work per day, absence of proper food and living/sleeping condition, forced and total cut off from their family members, bounded labor , sexual exploitation by agent during transit, at the office of agency and at the work place in houses of employers are some of the very common exploitation issues, although the list of exploitation of domestic workers is endless and is also frequently reported upon by the media.

USD Consortium feels the need to create mechanisms to listen to the voices of domestic workers and engage them in the national development process.

EDUCATIONAL WORKSHOPS/TRAINING SESSIONS/SUMMER CAMP FOR CHILDREN OF DOMESTIC WORKERS

Often, because of the discrepancy in education and upbringing, the children of domestic workers are found to be under-developed due to non-availability of resources. This inherent limitation often leads to frustrations & disappointment in the lives & mental development of these children.

USD Consortium regularly organizes many educational events / competitions / camps for the children of domestic workers to improve their personality and provide them the opportunity of getting quality education.
